Sydney 21st March 1865

My dear Sir

James and Samuel Wheeler have been with me to day with reference to the perfecting of their titles to the farms bought by them in 1855 which had remained in abeyance ever since by reason of the land being subject to two charges, the one of £10,000 to the Trustees of your and Mrs Macarthur's settlement, the other of £3000 to the Trustees of Sir Henry and Lady Parker's settlement. The former has I believed been discharged, but the latter I believe still subsists and until discharged must remain as a blot upon the title. I should be very glad to advise the parties to accept the bond of indemnity of yourself and Sir William, but I can hardly feel myself justified in taking the responsibility, because, though the risk is small to the parties, the title is not marketable with this defect
