purposes, and that the situation is preferable to that on the opposite bank of the Nepean River : - and

Secondly, that if there be any fences or buildings upon the Lands in question, belonging to Government, for which an allowance should be paid, the value thereof shall be ascertained & certified in writing by the Surveyor General of the Colony, and the amount of such valuation paid by Mr MacArthur into the Treasury of the Colony within twelve months from the date of the notification thereof to Mr MacArthur; provided, however, that Mr MacArthur shall be permitted to appeal against such valuation to the Governor & to Lord Bathurst, if he shall think fit to do so, - Mr MacArthur paying
