in a tender under Lockarts advice he was intimidated, and believing that he would secure them at a nominal rent as new runs he did so, as he stated upon both merely to save himself the risk of an expensive law suit such as I was subjected to.  Besides if there was any spare country there Reid was entitled to have had it under his tender for new runs.

If the sale of the runs are persisted in, I shall probably have to buy in again under protest and try the case again before a Jury, notwithstanding the Judgment of the two Judges.  Their Honors misunderstood and misapplied the term "adjusted" to my runs which were properly "forfeited" runs.   The general heading of the notice offering the runs for sale was
