which was served on McArthur next morning and his body lodged in the county gaol in this day 26 Jan.  The 6 members met again calling themselves a court but the Patent of the colony acknowledges no court, neither civil nor criminal without the Judge Advocate but they assuming this power kept their siting and official note to the govt. which correspondence no doubt will be sent to His Majest-ies Ministers through a proper medium as well as all their proceeding—
       Being at Sydney at this time I could plainly see through the whole of this day that the Military was much inraged and was sure that something very serious would take place and between 5 & 6 oclock in the evening I saw the Military gathering together from all quarters when Major Johnson come in from his country estates accompanied by Lieut Minchin upon his arrival he took upon himself to release McArthur out of gaol and signed his name Lieut Govr - the one at which as doctor Townson told me himself that Captain Kemp & Mr Bailey each rote a page the purport of which was to remonstrate - that these two papers was given to Dr Townson to correct - that he with drew by himself and finding by examination that Mr Baily would be the least trouble he began to correct it when Mr B went to him and took and rolled his paper up in his hand and put it in his pocket saying that they had got one that would do the business =
