The next morning another warrant was issued by order of the Bench signed by the Judge Advocate addressed to the Chief Constables of Sydney & Parramatta who apprehended Macarthur and took him before the then siting Bench of Magistrates from whence he was committed to take his trial at the next Criminal Court for various misdemeanours/but admitted to bail -

On Monday the 25th January a criminal court was opened for the trial of such criminals that came before it when John McArthur Esq came forward among the rest.  The court was to be composed of the Judge Advocate and 6 military officers agreeable to the Govt Order.

The day preceding it notwithstanding was Sunday a great ------ rondevouz was appointed where the military officers that was to try McArthur and Michael Long and a great retinue assembled - the - Drums was beating the colours flying - and excessive drunkenness etc ensued which was no doubt the wished for preparation for trial & Revolution.  Some time in the night Major Johnson left the party intoxicated got thrown out of his chaise and by report he was almost
