Winters the Groom at Galvins helped to drive her in from the ranges, I think from the Clifton side Hilyer broke her in. On the 2nd May 1855 I sold her to Apps who was then in our service with the understanding that he was to sell her again to some one who would prevent her getting out on our run.
Old Modesty her dam was sent to Melbourne in 1857 with two fillies or rather female produce all of which are in the Catalogue of horses sold by Watson & Co. viz

page 8 - no brand - Bay &c.
If Apps had been questioned on the former occasion he would have given evidence as to his knowledge of the mare being our property & a daughter of old Modesty, Witcher too knows the mare, but James Bowman was conversant with the whole transaction and knows the animal thoroughly. It is a most imprudent attempt on the part of Brand and I hope he will be made to pay for it.
How can he know an animal that has grown up from an unformed state to full development (and have been broken in too) during the time which according to his own statement she was absent from his means of observation and again he swears to a brand which is not to be seen by any one else.
