Particulars of Plaintiff's Claim

To thirty pounds value of a Mare belonging to the Plaintiff and of which he was before and at the time of the taking of the said Mare as herinafter mentioned lawfully possessed as of his own property which mare is of a brown to Bay Colour with star in forehead near hind foot white a little white above the hoof of off hind foot, with a faint heart [see drawing of heart on image] brand on off shoulder scarcely perceptible.  The said Mare has a running at one of the ears of a white water colour substance and was taken from an enclosed paddock or run of the Plaintiff situate at Mittagong near Berrima about the beginning of the year 1856 and is the Plaintiffs property he having bread and reared her from the year 1850 when she was foled in his paddock and the said Plaintiff never sold or lent her and being so possessed thereof the Plaintiff afterwards lost the said Mare out of his possession and the same then came to the possession of the Defendant by finding but the defendant well knowing the premises but contriving and intending to injure the Plaintiff in this behalf hath not as yet delivered the said Mare to the said plaintiff although demanded so to do.  And the Defendant afterwards to wit in February 1859 near Camden in the County of Camden in the Colony of New South Wales converted and disposed of the said Mare to his own use to the damage of the plaintiff of £30.0.0.

The Plaintiff also claims damages for the use of & work done by the said Mare at the rate of ten shillings per week exclusive of her keep from February 1859 to November 1860 ninety one weeks to the damage of the Plaintiff, £45.0.0

and the Plaintiff claims - £75.0.0
