Vine Diseases Act Amendment.
Board may direct Inspector, &c., to destroy vines, &c.
3. The Board, after inspection of any vineyard, and with the consent of the Minister, may direct any Inspector or Assistant Inspector to destroy any vines in any vineyard found to be diseased, in such manner and at such time as they shall authorize and require. And every such direction shall be as sufficient an authority to such Inspector or Assistant Inspector as if the same had been given by the Minister.
When compensation to be settled.
4. Before any vines shall be destroyed pursuant to the last preceding section, the Board shall endeavour to agree with the owner of the said vines as to the compensation to be paid to him for injury caused to his property by reason of such destruction; but if the Board and such owner cannot agree as to the amount of the compensation within fourteen days from the date of a notice to treat to be given by the Board to the owner, then the Board may direct such destruction of vines to be carried out forthwith ; and the compensation in that case shall be determined by the Board, subject to the approval of the Minister. In no case shall any greater amount of compensation be awarded than the actual cost of formation of the vineyard or portion thereof in which vines shall have been destroyed pursuant to this Act.
Number of Board.
5. After the passing of this Act the Board shall be composed of five persons to be appointed by the Governor, any three od whom shall be a quorum.
