circumstances, did pray, that I could not remove him from his situation, and the Six Officers might be summoned to appear before me to answer for their crimes, which to him appeared reasonable.

         37th.  The Memoriae having been read in my presence, and in the presence of all the Magistrates, and sworn to by Mr Atlkins. I ordered a summons to be sent to each of the Six Military Officers, to appear before me the following morning at nine o'clock (as it was at this time too late to proceed) that they might answer to the said Memoriae of the Judge Advocate.  I also ordered the Magistrates to attend at the time appointed, and I wrote to Major Johnston, a second time, suggesting if he was not able to be at Sydney at this examination, the propriety of Captain Abbott's being sent for from Parramatta to take command of the Troops. The Troopers Messenger, whose name was Tollis and who carried this Letter, soon returned and said, the Major desired him to inform me that he was so ill as to be unable to write, but that, he would get a Person to write an answer in the Evening.
