Gentlemen

Holding my Commission as the Provost Marshall of this Territory, under His Majesty's sign manual, and counter signed by one of His Secretary of state, I contend it to be my duty and corresponding with my allegiance to my gracious Sovereign to deny your Jurisdiction as a Court and therefore your competency to try me; for according to Blackstone Page 267 "All "Jurisdictions of courts are either mediately or immediately derived from the Crown, their proceedings run generally in the King's name, they pass under his Seal, and are executed by His Officers."  And the Act of Parliament, on which the Patent for establishing a court of criminal Jurisdiction, in this Territory is founded, has provided that in case of the death of the Governor or of his absence from the Territory, then the Lieutenant Governor, or the officer next in Command is empowered to take on him the administration of the Country; but in this Case the Governor
