It is our Royal will & Pleasure that no intercourse Shall take Place between our Settlements & other places which may hereafter be Establishd in the Coast of N.S.W. & the Settlements of the E.I.C. [East India Company]. The Coast of China & the Islands situate in that Part of the world & which intercourse has been Establishd by any European nation.
You are not therefore on any account to allow Craft to be built for the use of private individuals which may Enable them & Effect Such intercourse & you are to prevent any Vessels which may hereafter arrive from any of the places before mentiond from having communication with the people under your Government without your Especial Permission.

on the 31 Decr 1802 the Colonists had Procurd 144 Tons of oil & 47,402 Skins.

3. Ship building in N.S.W.
The Seal Fishery has been very Profitable to those who have Entered into it. Several individuals have built vessels larger than H.M. instructions seem to altow, this was Permitted by Govr Hunter & Continued by Govr King on the Express Condition in the Register of not being allowd to go beyond the Limits of this Territory which has never yet been attempted. The Govr has permitted Mr Campbell to build a Ship of 130 Tons under Bond not to Send her beyond the Limits of this Territory without his Permission, Govr Kings Letter to London 1st. March 1803.
The application made is to Enable the inhabitants to build vessels Sufficient for the Whale fishery & of Course able to go to China. The Governor Complains of the americans for Fishing on the Coast & carrying the Produce to China. He thinks the Colonists Should have the Same privilege, E. Cooke to S.r S Cottrill March 20 05
4. Mess, Enderby &c Objections
A Fishery is Establishing in N.S.W. which Threatens the destruction of the S. Whale Fishery Carried on from G. Britain in British vessels.
The Lady Barlow from built in Pegu at India has part imported a Considerable Quantity of Oil & Skins Caught by small vessels of Port Jackson now Employed in the Fishery. This importation has Lowerd the value of oil, Enderby & Co Mathew & Co 18 Jul 1805. They Submit whether restrictions Should not be laid on Such importation in Favor of British Ships. The Same Letter was sent July 18 1805 Jan 6 1806 & May 22 1806 Stating that Sidney of 900 Tons burthen is now expected with a Loading of oil & Skins
