Dear Sir

After many delays & a correspondence with Mr Penell concerning the 50 sided  monster which did not at any period of it promise an amicable Termination I have at last come to a settlement which that I hope will be approved which is that on condition of his striking off £100 we will agree to pay the remainder.

When the bill came to be examined it did not appear to be so shamefully over charged as I expected the great expence arose from the multiplicity of trials, every one of which incurred Council fees Court fees &c &c & it is true that Mr Penell's conduct in allowing different pieces to be tried to settle the same question was very blameable but in truth they were tied to the fees &c &c fairly paid upon them hence the Foundation of the enormous cheque. 

I employed Messr Peart & Miller to look over the bill relying on their good conduct which I had so lately experienced in the Sibrey Tithe cause we might I believe have been justified in striking off something more than what they advised as I readily agreed to act with liberality even towards our Enemy.
 
on his side he Mr Penell has an undertaking by which he can signed by us all to my utter astonishment for Stepherson signd for me  which could entitles him to bring actions seperately & individualy against any or all of us for the amount of his whole bill.  With these actions he might have legaly tormented us not a little & run up without our having the possibility of helping ourselves in considerable additional  & the charges which were meant
