Warrior in Torbay 28 Febr 1805

My Dear Sir

We arrived here on Friday the 22 Inst and the westerly Winds appear to be so thoroughly set in that I hope to remain for some time. The Fleet consists of 14 Sail of the Line, and are now moored.  I don't know whether you may have heard of a charge preferred against me by Leut Frazer [Frazier] since November last, it is now decided; but I thought it improper to mention the circumstances to you before, from motives which I am sure you will approve of, and which I mentioned to Mr. Marsden. This trial came on on Monday last, the prosecution ended about 5 that evening, and I had until next morning at nine o'Clock to prepare my defence.  The Prosecutor was tried by me in November last year for disobedience of order & acquitted; after which, he wrote for a trial on me for insulting him, & ill treating him, calling him a rascal & a scoundrel & also other Commissioned Warrant and Petty Officers - his letter was dated 13 Novr.  The charges were not only heavy, but artfully managed and supported by determined swearing, which
