I was very much surprized at not hearing from my Agents that Notice of Trial had been given in this Cause: and upon writing to them to know the Reason I find, that the Plt who has from Time to Time obtained Judges Orders for time to plead, did not deliver his Plea in Bar until yesterday Sennight: which demands a special Replication from us before the Plt is compellible to deliver Notice of Trial. Immediately upon receiving the Plea in Bar my Agents laid it before Mr: Sergt: Bayley with Instructions for drawing the Replication: but on Account of the great Length and Intricacy of the Plea he has not been able to complete it yet; and says, he must take some further Time to consider it well. It will therefore now be impossible to compel the Plt to proceed to Trial at the ensuing Assizes.
