Sir

I have receivd two letters from you on the subject of the Thermoloupe invented by M Lebon of Paris & improvd by M Wintzaler of Spain & requesting this in case you are the first person who send over a description &c model of it to England you may be gratified with a Patent for the exclusive privilege of constructing it in England

On the 10th inst I was favord by Mr Spencer Smith late H.M. Minister at Constantinople with the perusal of two letters from the Compte Attems de St Croix the one dated the 5th & the other the 26th of Feb in which the Compte also states himself to be one of the participants in the Imperial Patent given to M Wintzler desires that gentleman to sollicit an Patent English Patent for him the Count & by these letters I deem that you Sir have communicated to me the intelligence I have receivd from you on that subject at the desire of the Compte Attems

In answer to those different applications I trouble you with this to inform you that in England the issue of an exclusive patent in favor of any perceived new invention or introducd any article of public utility is seldom if ever deferd when sollicited by an attorney as is always done & that the expence of such a patent is about £60 Sterling The legality of this Patent however, which rests solely on the proprietor if it being actualy either the inventor or the first introducer of the invention into England is left entirely to him who will not apply for it unless he beleives that he is duely entitled to it

I do not yet think that the Government here will interfere on the business they certainly will not do anything to oppose it but it does not seem to be their interest to promote it because the people are supplied here with wholesome fuel at reasonable rate from the coal pits, because a considerable revenue arises from the duties upon coals carried coastwise & prospecting a still greater may be obtained whenever a Tax is laid on the article as it is recoverd from the Earth because the carrying trade of coals between the Pits & the Ports where they are concerned punishes a journey for the hardiest & best seamen
