Action was brought against you as Sheriff - In the mean Time in pursuance of the advice I had given the Bailiff Stredder to continue his pursuit, after he had taken a great deal of pains and been at an immense Expense, Darby was retaken and brought to Gaol, of which I immediately gave the plaintiff Notice by informing his Attorney Mr. Smith of Newark; This Gentleman thinking you a much better person to look to for his Money than Darby who was worth little or nothing, refused to drop the Action he had commenced for the false return and proceed against Darby in Gaol which he should have done, but came over to the Castle and actually contrived and advised the Release of the prisoner - The Action was proceeded in and at our Assizes the Matter was so favorable to us that if they had not actually two Days before the Trial came on, heard of Croppers taking the Money for Darby's Escape they could only have got a Verdict for one penny damages, - Which the Judge Indignant at the Action and the Manner in which it had been supported, directed the Jury to give - As it was, however, they got a Verdict for - Cropper's Misconduct for part of the Expenses they had been at, viz - 10£ which I shall certainly make the guilty Bailiff pay as well as all the Expenses - Mr. Sutton who was one of our Counsel will explain the Matter fully to you when he returns from the Circuit - And I can only say that I am very
