request of Major Johnston, left the Porpoise and took the Command of the Lady Nelson Tender. In consequence of this, Captain Kent wrote to me to know how he was to act with respect to him, the Vessel, and Lieut.t James Symons - in reply to which I sent him orders that Lieut.t Ellison and every Officer of His Majesty's Ship Porpoise must occupy their respective situations agreeable to the Establishment. It appears from the Correspondence (marked B) between Cap.t Kent and Lieut.t Symons, that the latter asserts he was discharged from the Porpoise, which assertion is not correct; for although he was superseded in the Command, he was not discharged from the Ship, and Captain Kent ought to have kept him on the Ships' Books. My situation as a Prisoner prevents my taking any further steps at present to detain Sirius, which it was the duty of Captain Kent to have done, but I submit to their Lordships, how he should be treated on his arrival in England, who was a Mutineer, Deserter, a Rebel Magistrate, and a Member of the Criminal Courts
